These Terms of Use ("Terms") govern your access to and use of ThePineBridge.com (hereafter the "Site"). By using the Site, you agree to be bound by these Terms, including the legal notices, privacy policy, and disclaimers available on our website.  We encourage you to review them carefully, as they detail your rights and responsibilities when using our platform.

PineBridge reserves the right to update these Terms at any time.  Your continued use of the Site following any changes to the Terms constitutes your acceptance of those changes. 

PRODUCT INFOMRATION AND FLYERS

We cannot guarantee the availability of all products described on the Site.  Some products may be temporarily unavailable due to inventory constraints or unforeseen circumstances.  We will update our website with the latest availability information.  All prices shown are before any applicable tax.  PineBridge reserves the right to limit quantities and to correct pricing or typographical errors prior to processing a purchase request.

PineBridge strives to provide accurate product information such as images, color, and pricing.  However, we cannot guarantee the accuracy of all specifications, pricing, warranty, or other product information.  PineBridge is not liable for any errors or omissions in such information.  If you are not fully satisfied with your purchase, you may return it in accordance with our Return Policy (See Return Policy section).  Price and availability of products and services are subject to change without notice.

ORDER REQUEST / ACCEPTANCE

Your order submission is a request for PineBridge to sell you the specified products or services.  We will provide you with an order confirmation email and regular updates on the shipping status of your order.  PineBridge reserves the right to accept or reject your order at its sole discretion, for any reason, including due to supply shortages or unforeseen circumstances.

FREE SHIPPING

We offer free standard shipping on all Canadian orders over $100 (before taxes) to most locations in Canada.  Expedited shipping options and delivery to remote locations will incur additional charges.  For a quote on expedited shipping or shipping to a remote location, please contact us at patrick@thepinebridge.com

SHIPPING AND DELIVERY

Once your order is confirmed, we will pack and ship it as soon as possible, typically within 1-2 business days, based on product availability and resource limitations.  Shipping lead times may vary depending on your location:

  • Major cities: 4-8 business days
  • Remote locations: Additional days may be required

RISK OF LOSS

Title to items purchased from PineBridge passes to the purchaser upon delivery to the shipping carrier.  However, the risk of loss for the products remains with the purchaser until they are received.

In the event that the products are lost or damaged during shipping, PineBridge will assist the purchaser in filing a claim with the shipping carrier.  However, PineBridge is not responsible for any losses or damages incurred during shipping.

DAMAGED PRODUCTS

If you receive a damaged product, please contact our customer service team immediately.  We will work with you to resolve the issue promptly. Depending on the extent of the damage, we may offer you a replacement or a refund. 

DISCREET PACKAGING

We understand the importance of privacy. All orders are shipped in plain, unmarked boxes for your comfort and discretion.

BACKORDER/OUT-OF-STOCK

If your order includes items that are currently out-of-stock or on backorder, our customer service team will contact you within two business days to provide an estimated delivery time or to discuss other possible solutions.

For items with a short lead time (generally 2-8 business days), we will ship your order as soon as the item(s) become available. We will provide you with regular updates on the shipping status of your order.

For items with longer lead times or items that are no longer available, we will offer you one of the following options:

  • Exchange the item(s) for a comparable product(s) that is in stock.
  • Balance-cancel the long lead time/out-of-stock item(s) and receive a refund of the corresponding item(s).
  • Cancel the order and receive a full refund.

ORDER CANCELLATION POLICY

PineBridge reserves the right to cancel orders in certain circumstances, including:

  • Product Availability:  If a product is out of stock or unavailable.
  • Shipping Restrictions:  If we are unable to ship to a specific address (e.g., PO boxes, APO/FPO addresses, or restricted regions).
  • Product Recalls:  If a product has been recalled due to safety concerns.
  • Suspected Fraudulent Activity:  If we suspect fraudulent activity, such as unauthorized use of credit cards, bulk orders for resale, or any transaction alerted by fraud prevention department.

We will notify you via email if your order is canceled.  In the event of a cancellation, we will issue a full refund to your original payment method.

PAYMENT METHOD

We accept the following payment methods: Shop Pay, Visa, Mastercard, American Express, PayPal, and debit card (when it is co-branded with Visa, Mastercard, or American Express). 

NOTE:  To use a debit card, it must be co-branded with one of the listed credit card providers.  To see whether your debit card is co-branded, you can simply check if a listed credit card logo is printed on it.

RETURNS POLICY

We offer a 30-day money-back guarantee on most products.  To be eligible for a return, items must be in their original condition, unused, unopened, and not on the Non-Returnable Items list below.  Please note that shipping costs are non-refundable.

Non-Returnable Items:

  • Clearance or Sales items
  • Gift Certificates or Cards (No Cash value)
  • Walkers, Wheelchairs, Rollators, or Power Mobility devices
  • Incontinence Products (due to their hygienic nature)
  • Bath Safety Products
  • Face Masks & accessories
  • Electronics (unless within 14 days of purchase date)

If items returned to us are found to be used or not in original packaging, the items will be rejected and no refund will be issued

It is crucial to obtain a Return Authorization Number before returning any product.  Failure to do so may result in delays or rejection of your return.  Generally, the shipping cost of return is responsible by the customers unless the return is due to our error.  PineBridge is not responsible for returned items until they arrive at our facility with the appropriate authorization.  Items returned to our facility without appropriate authorization will be discarded at the sender's own cost. 

For damaged or defective items, please contact our customer service team within 14 days of receipt. We will provide instructions for returning the item and may offer a replacement or refund.

Communications to You

You agree to receive all communications, including but not limited to agreements, notices, disclosures, account information, and marketing materials, from us electronically.  These communications will be sent to the email address you provide.

You further agree that all such electronic communications satisfy any legal requirement that such communications be in writing.

GENERAL DISCLAIMER

You agree that your use of the Site is at your sole risk. The Site, its content, and services are provided on an "as is" and "as available" basis, without warranty of any kind, express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, title, non-infringement, security, accuracy, or completeness.  

PineBridge makes no representations or warranties about the accuracy, reliability, completeness, timeliness, or suitability of the content on the Site.  PineBridge disclaims all liability for any loss or damage caused by your reliance on information obtained through the Site.

PineBridge is not responsible for the content of any linked websites, including their accuracy, completeness, free from viruses, security, or legality.  PineBridge makes no endorsements or representations of any kind regarding the products, services, business practices, content, or appropriateness of content on such websites.  Users irrevocably waive any claim against PineBridge with respect to such websites.

DISCLAIMER ON HEALTH INFORMATION

Any health information provided by PineBridge on the Site is for general informational purposes only and is not intended as a substitute for professional medical advice, diagnosis, or treatment.  You should always consult with a qualified healthcare provider regarding any medical questions or conditions.  

PineBridge is not responsible for any health consequences arising from the use of information provided on the Site.  You should not rely on the information on this Site to diagnose or treat any health problem or disease.  Always consult with a healthcare professional before making any decisions related to your health.

INDEMNITY

You agree to indemnify, defend, and hold harmless PineBridge, its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or in connection with (i) your use of the Site; (ii) your violation of these Terms of Use; (iii) your violation of any rights of a third party; (iv) your negligence or willful misconduct; (v) your breach of any applicable laws or regulations.

LIMITATIONS ON LIABILITY

To the fullest extent permitted by applicable law, in no event shall PineBridge, its officers, directors, employees, agents, licensors, and suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Site; (ii) any conduct or content of any third party on the Site; (iii) any content obtained from the Site; (iv) unauthorized access, use, or alteration of your transmissions or content; (v) any errors, omissions, or interruptions in the availability of the Site or its services; (vi) any failure of performance of the Site or its services; (vii) any bugs, viruses, or other harmful code that may be transmitted through the Site.

MUTUAL RESPECT

PineBridge is committed to providing a professional and respectful customer service environment for both of our customers and for our staff.  If a communication is found abusive, disrespectful or unreasonable, for example, use of profanity, vulgarity or coarse language, towards our staff, PineBridge reserves the right to take appropriate actions, at its sole discretion, such as:

  • Termination of the current communication channel (phone call, email, chat);
  • Refusal to complete a transaction or order fulfillment; and/or
  • Account termination (in extreme cases of repeated or egregious behavior).

In the event resulted to order cancelation, PineBridge will notify you via email to the address provided.  Cancelled orders will not be fulfilled or shipped.  A full refund will be issued to the original payment method used for the canceled order.

We expect all PineBridge staff to treat every customer with respect and professionalism.  If you have a complaint regarding the communication from a PineBridge staff member, please direct it to patrick@ThePineBridge.com where it will be reviewed by our Director of Customer Service.  PineBridge takes all complaints seriously and will investigate all reported incidents.  Appropriate action will be taken up to and including disciplinary action.

CUSTOMER REVIEWS / COMMENTS

By submitting a review or comment on the Site, you agree to the following:

  1. Ownership and Accuracy:  You are the sole author and owner of the content you submit.  The content is accurate and does not violate any laws or third-party rights.
  2. Moderation:  PineBridge reserves the right to moderate, edit, or remove any content that violates our guidelines or is deemed inappropriate.
  3. License Grant:  You grant PineBridge a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display your content in any media.  
  4. Indemnification:  You agree to indemnify and hold PineBridge (and its officers, directors, agents, employees, and third-party service providers) harmless from all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, including reasonable attorneys' fees, arising out of or related to your use of the Site, your violation of these Terms of Use, or your violation of any rights of a third party.

GOVERNING LAW AND JURISDICTION

This website is controlled by PineBridge and is governed by the laws of the Province of Ontario, Canada. By accessing and using this Site, you agree that all matters relating to access to, or use of, the Site, or any other hyperlinked website, shall be governed exclusively by the laws of the Province of Ontario, Canada, without regard to conflict of laws principles.  

You also agree to submit to the exclusive jurisdiction of the courts of the Province of Ontario and waive any objection to jurisdiction or venue laid in such courts.

You are responsible for complying with all applicable local laws and regulations. You agree to use this Site and any of its services in compliance with all applicable laws, statutes, ordinances, and regulations.

PineBridge reserves the right to investigate and take appropriate action, including reporting to law enforcement, in the event of suspected or actual violations of these Terms of Use or our Privacy Policy.
